As a new mother we are full of excitement and hope for the future.... for our new bundle of joy, and for our family. We often dream as little girls, we are either going to someday conquer the world or grow up and get married and start a family. Perhaps readily both! When the time comes to give birth we are both nervous and hopeful, but dream of holding our baby in our arms. We dream of nurturing and loving that baby and raising that child for the rest of our lives. This could be your family....... Several years ago a young mother by the name of Sara Ybarra-Johnson began her journey into motherhood. Her labor was painful, intensive and long. Arrowhead Hospital in Arizona administered Pitocin to speed up the labor, however in a near fatal mistake, the hospital, also administered medicine to stop her labor. This caused Sara to have respiratory problems. Little Isaiah, who was still in the womb, was experiencing distress as well. He had the cord wrapped around his neck twice. Sara ended up having a C-section. Little Isaiah unfortunately had complications at birth, such as respiratory distress and seizures. He was put on heavy doses of anti-seizure medication without even a chance to see how his little body would do. Sara and her son were transferred to two different hospitals and eventually ended up at Phoenix Children's Hospital. Isaiah was later diagnosed with Cerebral Palsy. Isaiah did not experience any more seizures after that but struggled in many other areas. Isaiah qualified for DDD Services (Department of Developmental Disabilities) in Arizona, which allowed him the chance to receive therapies. Time went by and Isaiah grew up he was now 14 months old, and was making great progress. Time came to a screeching halt when he was ripped from his mother's loving arms because a new therapist, who had only visited with Sara's son 3 times, “thought” Isaiah was having seizures. Even though he was under the care of a medical doctor and he was not experiencing seizures, this non-licensed medical professional decided to call CPS anyway. He was, in fact, having tonic spasms exhibited by spastic arching of his back do to his Cerebral Palsy. Regardless, this employee from The Foundation for the Blind (Isaiah was seen for vision issues,) called the CPS hotline and filed a report, altering the lives of this family forever. At That Time..... Karla Johnson, Sara's mother owned a beautiful five bedroom home. Sara, who was living with her mom at the time, had a supportive family. Financial Devastation..... Like many Arizona families they lost everything. Karla lost her wonderful home, her high paying job, and her car trying to get her grandson back and help her daughter. The financial toll was devastating. What If This Was You? What If This Was Your Family? If the Arizona CPS system worked properly, this child would have never been taken in the first place, but once he was, he complicated medical issues was evaluated. In theory, it all should have, and could have been resolved almost immediately, right? The Arizona system has been broken for years. There is excessive internal pressure, that has been multiplying and escalating, and is in essence a ticking time bomb! The Johnson's case is not the only one, the Pellerin's, Meltzer, Diegel, Espinoza, Patterson, Brown and more are just a few that have come to light recently. There are thousands more. Sara Was Marked Then TARGETED Without a Chance to Prove Her Innocence 1. Sara was placed on the central registry within 2 weeks of having her 1st son taken, rendering her a child abuser for life. She asked for an administrative hearing to dispute being put on the central registry, but was denied due process. (All this, before she had even had a trial in dependency court where the state has to prove beyond a "preponderance of evidence" that she was a "neglectful mother." 2. When the case manager was questioned and a report was filed after doing a home check, she stated “Isaiah was not in danger.” If he wasn't in imminent danger than why was he taken away? 3. Sara's evidence was not permitted in court, which proved Isaiah had NEVER experienced medical neglect under the mother or grandmother's care. He was "seizure free" per Dr. Chapman's report. 4. Karla Johnson sent a letter to Charles Flanagan, the head of DCS asking for help. She even sent the doctor's report showing the head injuries her grandson Jayden had sustained in foster care. Flanagan told her not to contact her anymore. 5. Isaiah did not qualify for IV-E funding. Sara lived with her mother and the income would have been based upon the Grandmother’s earnings. 6. The grandmother Karla Johnson should have received top consideration for placement before any Foster Home, but young infants are a worth a pretty penny in the adoption industry, and kin are purposely overlooked so that the state can continue to receive federal funding. In the last court hearing, where they decided to sever the rights to Sara's 4th child, it was made clear that no home check was ever even done, at least in Jayden's case; and Karla, Sara's mother was instead instructed to 'just appeal'. Sara Has Had All 4 of Her Children taken by the State of Arizona. Two of them at birth! Isaiah was taken from his mother's loving arms at 14 months old for "medical neglect." Wilfredo was taken from the hospital at 4 days old, "because they had Isaiah." Josiah was taken at 3 days old from a hospital in Oklahoma, because "Arizona instructed them to take him." Sara's fourth child Jayden was not taken until he was 8 months old. When DCS stepped in to take Jayden they were aware aware of the lawsuit that Karla Johnson had filed against them. It is believed that additional false allegations were added such as: mental health issues, substance abuse, domestic violence and neglect in order to stop this family from continuing to advocate against the Arizona court system, none of which exist or have been proven. The Truth: All 4 children were born clean and drug free. Sara suffers from anxiety and depression from having all four of her children taken away by the state, which is stated by her doctor. Sara does not have a substance abuse problem. Domestic violence is not an issue. Sara has never neglected her children and has documentation of in-home therapy visits and doctors reports to prove it. The Johnsons have had a total of 27 judges and 20 case workers. This would make it hard for any family to work their way through the system. How could they appropriately communicate what their family was going through, especially if false allegations are being passed along to each subsequent replacement worker and the court system implied as fact, (but completely unsubstantiated with any kind of proof?) They were even denied due process in their appeals. In addition, the courts have only heard hearsay with words such as "they might", "she might", "allegedly", with no expert testimony ever being offered in court against their family, in regards to all four of the childrens removals. "It's not a matter of evidence, Ma'am." -Judge Sinclair Maricopa County Arizona Most recently, in Sara's last court hearing in January of 2014, the Judge told Sara the state was moving to terminate her parental rights and adopt out her fourth son. Sara's prior three children have already been adopted out, usually pre-determined and placed into the foster home of a family that wants a baby! Ignoring the heart wrenching outcry from Isaiah's mother, Sara, Judge Sinclair boldly states: "It's not a matter of evidence, ma'am," and the question of, "how does the state have enough evidence to switch the case plan to severance and adoption" is ignored for the 4th time.
